I took this during an evening shower (a rare evening shower this summer as we’re about to beat the record of number of days over 100 degrees) heading east on 45th street near Burnet Rd. I was at a full stop at a light. I’m guessing that if the new “texting while driving” ban that the Austin City Council approved this week eventually gets passed, I could get ticketed for doing this. They’re going to have a difficult time enforcing that one fairly.

    Since when were any laws applied “fairly” ?

    Since not everyone who speeds is ticketed for speeding, why would everyone txting be ticketed.

    Perhaps I should have chosen my words a little more carefully. You’re talking about selective enforcement. They can’t possibly catch every speeder just as they can’t possibly catch every texter.

    I think the difference between this and speeding is that, for the most part, it’s clear if a person is speeding or not. If they’re over the limit, they’re speeding. Telling whether or not someone is texting is more difficult to determine. Are they going to ticket you just for having the phone in your hand? Seems like they’d have to ban all cellphone use. How do you tell the difference between dialing and then talking on a hands-free set? Should I be ticketed for taking this picture while stopped at a red light?

    Well, in so much as there is a total ban on the use of “handsets” in many states and countries, it easy indeed to tell if someone is breaking the law, they simply only need to have their phone in their hand. I’m not aware of the proposal in this instance.

    I too should have chsen my words carefully, everyone who is txting SHOULD be ticketed. I should have said Since it is not possible to catching everyone who is speeding and ticket them, how will it be possible to catch everyone who is txting and ticket them ?
